The only thing that even approximates a loophole happens to be enshrined in the Official 2024 NCAA Division II Swimming & Diving Championships Geneva, OH Shirt and I will buy this Tenth Amendment to the U.S. Constitution: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” The federal government has the right to regulate interstate commerce, that is, between the states. Under that authority, it has the right to control lawful interstate shipments and sales of firearms and has limited such shipments and sales to federally licensed dealers. Except for things like sending a firearm back to the manufacturer for modifications, recalls or repairs, it is a federal offense for a private citizen to ship a firearm to any person in another state. Since 1994, the federal government has required a background check for any transfer of a firearm by a licensed dealer to an end user. The Founding Fathers did not give the federal government the power to regulate intrastate commerce, i.e. a lawful, private transaction between two residents of the same state that takes place entirely within that state. Because of that, the federal background check requirement cannot be applied to the individual states, unless the state has passed its own law requiring background checks on private sales.
Most states do not have their own background check law, so private sales of firearms can take place at gun shows, homes, restaurants, etc., and still be in full compliance with that state’s firearm laws. The person selling the Official 2024 NCAA Division II Swimming & Diving Championships Geneva, OH Shirt and I will buy this firearm is still required to take reasonable steps to ensure the buyer is a resident of the same state, of legal age to purchase a firearm (18 for most rifles and shotguns; 21 for handguns and some military-style rifles) and not prohibited from buying or possessing a firearm. Incidentally, federal law does require that any person engaged in the business of buying and selling firearms must have a federal firearms license. However, the law does not provide a clear definition of what qualifies as being in the business. That’s probably as close to a “loophole” as one is going to find. Quick(ish) background in U.S. Federal gun law (if this is nothing new to you, skip to the bold text about halfway down). Two major laws in 1968, the Omnibus Crime Control and Safe Streets Act and the Gun Control Act, restricted interstate trade in firearms based on the Federal government’s Commerce Clause powers. The GCA established a licensing scheme, the Federal Firearms License, for those who made a living having to do with making, transporting or selling firearms, and the OCCSSA prohibited any interstate transfer of firearms, with the subsequent GCA re-legalizing transfers between FFL holders and additionally requiring firearms manufacturers to initially transfer their newly-manufactured guns to an FFL-licensed dealer before they can be sold at retail (different license types; a manufacturer license allows you to make but not sell and a dealer license just the opposite). It also heavily restricted imports of firearms using a “points” system specifically targeting small handguns, and, perhaps most germane to our discussion, it criminalized any sale, gift, or other permanent transfer of a firearm to anyone the transferor (seller, giver) knows or has reasonable cause to believe is a convicted felon.
